Safety is very important to us, and we do everything we reasonably can to ensure that the property is maintained, that services are safe, and that participants are clearly informed of risks and responsibilities.

We operate entirely on an AT YOUR OWN RISK basis. In order to attend our location, receive services/treatments, or participate in events/activities, you (and your legal guardian if applicable) must carefully review and agree to the following agreement.

The Agreement

The following constitutes a legal and binding agreement between:

YOU the PARTICIPANT, and

Desirea Marie; Forged Solutions Services O/A Forged Soulutions Retreat & Wellness Center; the property owner; all contracted and subcontracted providers; COLLECTIVELY the PROVIDERS

Consideration:

1. Being of lawful age and in consideration of being permitted to participate in services, treatments and group activities, as well as enter and access the private property, I THE PARTICIPANT : Release and forever discharge the Providers, and their spouse, heirs, executors, administrators, legal representatives and assigns from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury or harm to person or property, including injury resulting in the death of the participant, under any circumstance or situation that may arise in direct or indirect connection with the participants attendance, participation and receipt of services or access, and notwithstanding that such damage, loss or injury may have been foreseeable, or caused solely or partly by the negligence of the provider.

2. The Participant understands that the Participant would not be permitted to participate in the treatments/services/activities, or enter and access the private property or property amenities described below unless the Participant signed this agreement.

3. The Participant understands that, in order to enable an ongoing working relationship and receipt of serivices, this agreement is intended to be in effect until or unless it is expressly revoked by the participant in writing to contact@forgedsoulutions.com. Regardless, you may be asked to review and re-confirm your agreement annually.

Details of the Services, Treatments and Activities:

4. The Participant has hired the providers, to provide personal services, which may include, but are not limited to: advice, readings, reiki, energy work, massage, yoga, meditation, Belief Re-pattering®, Thought Field Therapy®, Emotion Focused Therapy®, coaching, sound healing, personal instruction, etc., all based on their experiences, education and knowledge.

5. No guarantees are or have been made as to whether or not the client will obtain certain results from the services/treatments/activities provided. Results vary by individual. The Providers are not responsible for actions or reactions of Participants that do or do not follow “advice” given.

6. The Participant understands that food and non-alcoholic beverages may be provided, and that the Participant is responsible for their own choices and safety in respect of consumption and any potential allergies or effects. The Participant is requested to also inform the Providers of any allergies and their severity.

7. The Participant has also hired the Providers to provide access to personal property, which may include, but is not limited to, buildings, outdoor space (including open and woodland areas), sheltered space, tents, campers or other lodgings, parking areas, a natural wetland and body of water, hot tub, sauna, fire-pit, chairs, tables, inversion tables, watercraft, instruments, arts and crafts supplies, etc., based on the existence, availability and fit with the service/treatment/activity being provided.

8. The Participant is aware that accessing the private property comes with inherent risks, including but not limited to: travel, trips, falls, sprains, exposure to allergens, interactions with animals and wildlife, injury from fire, water, weather, acts of God, and so forth.

9. The Participant acknowledges and agrees to be respectful towards and in the use of any and all private property made available by the Providers. The Participant shall not use any property for any purpose other than as intended and instructed. The Participant agrees that they are responsible for any loss or damage to private property, as deemed in the sole discretion of Desirea Marie, Founder of Forged Soulutions Retreat & Wellness Center. The Participant agrees that they will pay for any damages caused within 30 days of notification by Desirea Marie, and that Desirea Marie may take legal action to pursue costs if deemed necessary.

Concurrent Release

10. The Participant acknowledges that this agreement is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant and with the intention of binding the Participant’s spouse, heirs, executors, administrators, legal representatives and assigns.

Fitness to Participate:

11. The Participant declares that the Participant does not have any physical limitations, medical ailments, physical or mental disabilities, etc., that would limit or prevent the participant from participating in the service/treatment/activity; OR that the participant has reviewed risks with their doctor or alternatively qualified medical professional, AND received authorization to participate from their doctor or alternatively qualified medical professional, AND disclosed such concerns to Forged Soulutions, Desirea Marie, or any contracted service provider PRIOR to the delivery of service/treatment/activity.

12. The Participant acknowledges that it is their SOLE responsibility to take precautions and ensure their personal safety during access to the property and amenities, and when receiving service/treatment/activity.

13. The Participant agrees that if there is any doubt in their fitness to participate, by either the Participant or the Providers, they will cease engagement in the service/treatment/activity, and obtain a medical examination and clearance to participate before resuming their participation.

Full and Final Settlement

14. The Participant hereby acknowledges and agrees that the Participant has carefully read this Agreement, that the Participant fully understands the same, and that the Participant is freely and voluntarily executing the same.

15. The Participant understands that by signing this Agreement, the Participant agrees to be forever prevented from suing or otherwise claiming against Forged Soulutions, Desirea Marie or any contracted service provider, for any property loss or personal injury that the Participant may sustain while preparing for, commuting to, or participating in a service/treatment/activity.

16. The Participant has been given the opportunity and has been made aware of their right to seek independent legal advice prior to signing this agreement.

17. This Agreement contains the entire agreement between the parties to this Agreement and the terms of this Agreement are contractual and not a mere recital.

Capacity to Enter

18. This Agreement must be completed by an individual who is at least 18 years of age and of full comprehension and capacity to enter into the Agreement, or alternatively, by a minor person or person with a legal guardian AND their legal guardian.

19. In the event this agreement pertains to a minor person or person with a legal guardian, it is further agreed that the legal guardian acknowledges and agrees to all the above terms on the persons behalf, AND assumes complete and full responsibility for the supervision and safety of that person at all times when they are at the property and/or receiving services or participating in activities. Further, the legal guardian acknowledges and agrees to bring and provide any lifejacket or other safety equipment needed by the person - this is to ensure a safe and proper fit for the person.

Governing Law

20. This Agreement will be governed by and construed in accordance with the laws of the Province of Alberta.

21. A paper signature, electronic signature, or submission of this form will all constitute an acceptable and legally binding agreement.

Whole Agreement

22. The Terms of Use constitute the entire agreement between you and us relating to the subject matter contained herein. This Agreement is subject to change at any time, with or without notice. All changes are effective upon their posting on the Site. You agree that it is your responsibility to bookmark this page and to check it frequently for updates to your Agreement with us.

Proceeding in Agreement

By signing a copy of this agreement on site, providing an electronic copy of a signed agreement, or completing and submitting the form below you are expressly acknowledging and agreeing to the above terms and conditions. You are entering into a legal agreement, in which you are waiving your right to sue or otherwise pursue any damages from Desirea Marie, Forged Soulutions Retreat & Wellness Center, or any contracted service provider, under any circumstance or for any reason related to your attendance or participation with us.

You may revoke your consent and discontinue services at anytime by emailing us at contact@forgedsoulutions.com with your full name and clear communication you are withdrawing your consent.
